Vizby Terms and Conditions
Welcome to Vizby. Please read these Terms and Conditions ("Terms", "Terms of Service") carefully before installing the Vizby Shopify Application (the "App", "Service") operated by EYweb ("us", "we", "our").
By installing, accessing, or using Vizby, you ("Merchant", "User", "you") agree to be bound by these Terms. If you disagree with any part of the terms, you may not access or use the Service.
Description of Service
Vizby is an artificial intelligence-driven Search Engine Optimization (SEO) and Generative Engine Optimization (GEO) platform built for Shopify merchants. The App provides services including, but not limited to:
- AI Visibility Tracking: Simulating search queries on Large Language Models (LLMs) to monitor and score brand visibility, sentiment, and share of voice.
- AI Content Generation: Automating the creation of blogs, article copy, and promotional content.
- On-Page Optimization: Generating metadata, JSON-LD schema markup, image alt-texts, and FAQs for products and collection pages.
- AGENTS.md Generation: Standardizing machine-readable directives for AI crawlers.
- Competitor Intelligence: Tracking competitor share of voice across generative search layouts.
Shopify Integration & Account Security
To utilize Vizby, you must grant the App permissions to access your Shopify store database through the Shopify API.
- Permissions & Scopes: You explicitly authorize the App to request permissions to read and write products, content, files, metaobjects, and reports (read_content, write_content, write_products, read_files, read_reports, etc.).
- Account Responsibility: You are solely responsible for maintaining the security of your Shopify admin account and credentials. Any action performed through your store's authenticated instance of the App is deemed your authorized action.
Subscription Plans, Billing, and Tokens
Vizby is billed on a subscription basis managed securely through Shopify's Managed Pricing and Billing APIs. All billing terms, cycles, and upgrades are bound by Shopify's merchant policies.
3.1 Subscription Tiers
Vizby offers multiple subscription tiers (e.g., Free, Essential, Growth, Scale, Enterprise). Each tier has designated allowances of:
- Content Generation Tokens (used for blog posts, rewrites, and translations).
- AI Visibility Tests (frequency and selection of tested models).
- Product and Collection Audits.
3.2 Token and Reset Mechanics
Paid Plans (Monthly & Yearly): Content generation tokens and audit quotas reset monthly on your plan's dynamic anniversary billing cycle date, regardless of whether you are billed monthly or annually.
- Unused Tokens: Unused monthly token allowances do not roll over to the next billing cycle.
- Token Consumption: Tokens are charged at the start of an AI task. If a system failure or network timeout prevents a task from completing successfully, the spent token is eligible for an automatic or manual refund to your account balance.
3.3 Cancellation & Grace Periods
Upon cancelling your Vizby subscription in the Shopify Admin, we honor your paid term:
- Monthly Subscription: You will retain access to your plan features and token resets until the end of your current monthly billing period, at which point the resets stop, and your plan reverts to Free.
- Yearly Subscription: You will retain monthly token resets and feature access for the remainder of your paid 12-month term, at which point resets stop and your plan reverts to Free.
- Post-Expiration: Once a cancelled subscription term expires, all remaining tokens are frozen or cleared, and no further monthly resets occur.
AI Content Disclaimer & Limitation of Liability
Vizby leverages third-party Large Language Model APIs (including OpenAI, Google Gemini, Anthropic Claude, and Perplexity) to synthesize data and generate content.
4.1 AI Inaccuracies and “Hallucinations”
AI models can produce inaccurate, incomplete, misleading, or outdated information (commonly known as "hallucinations"). EYweb does not guarantee the accuracy, truthfulness, or legal compliance of any content, descriptions, SEO recommendations, or FAQs generated by the App. It is your sole responsibility as the Merchant to review, edit, verify, and approve all AI-generated text, product data, and alt-texts before publishing them live to your storefront.
4.2 SEO and Ranking Disclaimer
The metrics, recommendations, and "AI Readiness Scores" provided by Vizby are estimates based on algorithmic assessments. EYweb makes no guarantees, representations, or warranties that using Vizby's recommendations or content will:
- Increase organic search rankings.
- Increase recommendation frequencies on ChatGPT, Claude, Perplexity, or Gemini.
- Increase traffic, conversion rates, or sales.
4.3 Third-Party Media Sourcing
Vizby utilizes the Pexels API to auto-select and embed royalty-free images. While we endeavor to fetch relevant images, we are not liable for the content, accuracy, or copyright compliance of images pulled from third-party networks. You are responsible for ensuring that featured storefront imagery conforms to your brand guidelines and local regulations.
Privacy and Compliance
EYweb values your store's data privacy and conforms strictly to Shopify's App Store developer requirements and privacy standards.
5.1 Customer and Shop Data Compliance
Vizby does not store or monetize your customer's personally identifiable information (PII). In compliance with GDPR and general data privacy frameworks, Vizby supports and immediately processes Shopify's mandatory privacy webhooks:
- customers/data_request: We will compile and deliver any personal data we hold upon a verified customer request.
- customers/redact: We automatically delete or anonymize customer personal data from our systems upon request.
- shop/redact: Upon uninstallation of Vizby, we delete and anonymize all store configuration, sessions, and identifying information, retaining only anonymized aggregated logs to prevent token/onboarding fraud.
Prohibited Uses
You agree not to, and will not permit any third party to:
- Use the App to generate content that violates local laws, promote hate speech, or infringe upon third-party intellectual property.
- Bypass, disable, or circumvent any rate-limiting, token-gating, or security mechanisms built into the App's hosting server (such as Netlify and Google Cloud Functions).
- Use automated scripts, crawlers, or bots to scrape data, analytics, or competitive intelligence from Vizby's dashboard interfaces.
Indemnification
You agree to indemnify, defend, and hold harmless EYweb, its creators, subsidiaries, affiliates, partners, officers, and employees from any claim, demand, liability, damage, or cost (including legal fees) arising out of:
- Your breach of these Terms.
- Your publication of AI-generated content that violates consumer protection, accessibility, truth-in-advertising, or intellectual property laws.
- Your storefront's transactions with consumers mediated by AI agents.
Modifications to Terms and Service
EYweb reserves the right to modify, suspend, or discontinue the App (or any part thereof) with or without notice. We may update these Terms from time to time. Your continued use of the App after any modification constitutes your acceptance of the updated Terms.
Governing Law
These Terms shall be governed by, and interpreted in accordance with, the laws of the jurisdiction in which EYweb is registered, without regard to its conflict of law provisions.
